The literature analysing Muslim perspective towards other religions is now quite extensive. However, when it comes to Muslim’s perspective towards Buddhism, the scholarship lags far behind. This article aimed to identify the Muslim views on Buddhism from a theological and philosophical framework. The Muslim views have a different category, on categorising Buddhism, the status of Buddha as a Prophet, and Buddhist as the People of the Book. Each view provides a different framework of Muslim perspective towards Buddhism. From the theological (...) view, one of the outlook is tolerance. Due to the rejection of Buddhist doctrine by most Muslim theologians, Muslims apply tolerance, which is subject to religious freedom stand on, ‘firm in principle, tolerant in attitude’. Tolerance encourages Muslims to adhere to the principles of truth, but does not erode the respect for other religion. While from a philosophical view, it considered Buddhism as a religion from God, as well as other religions. Thus, some Muslim inclusivists and pluralists recognise Buddhism. This research is qualitative. The method used in this research is descriptive-analytic, emphasising content analysis of the data from various books and articles covering Muslim view on Buddhism and the patterns of relations between Islam and Buddhism. Studies suggest the understanding of each framework to encourage Muslims to improve comprehensive interreligious dialogue with Buddhists.Contribution: Religious tolerance, inclusivism, and pluralism is a panacea to inordinate and incessant religious conflict, if given its proper place in Malaysia, it will breed harmony and peace in the society. The term non-governmental organisations (NGOs) has been well-known for the development of human rights, charity works and organisational developments. On the other hand, some NGOs also have their specialised roles to help the community such as in conflict resolution, cultural preservation, policy analysis and information provision. Apart from that, there are many categories of NGOs: Islamic-oriented non-governmental organisation (IONGOs), faith-based organisation (FBO), humanitarian NGOs (HNGOs) and government organised NGOs (GONGOs). However, in this research, the researchers focus on how IONGOs compare (...) with NGOs in assisting the lesbian, gay, bisexual, and transgender (LGBT) community based on four hijrah NGOs: Persatuan Islah Movement, Persatuan Insaf Pahang, Hijrah Republique Network and Usrah Iqrak. These four NGOs were chosen because of their roles in assisting the LGBT community. In this research, the researchers adapt the qualitative research by using a case study method; phenomenological approaches and a document analysis have also been applied as well. The result shows that these four IONGOs are different from the NGOs based on the seven typologies applied: intersection, distinct, substantive, subset, co-existing, atomistic grouping and constitutive. The implications of this article highlight the fact that IONGOs are different from the LGBT NGOs in Malaysia as they focus more on spirituality and an Islamic pathway. Hence, future research should include focus group interviews with all the members in NGOs that assist the LGBT hijrah in the community. This analysis demonstrates the application of a data duplication technique in linear regression with censored observations of the waiting time to third pregnancy ending in two outcome types, using data from Malaysia. The linear model not only confirmed the results obtained by the Cox proportional hazards model, but also identified two additional significant factors. The method provides a useful alternative when Cox proportionality assumption of the hazards is violated.

Background: Nurse managers have the burden of experiencing frequent ethical issues related to both their managerial and nursing care duties, according to previous international studies. However, no such study was published in Malaysia. The purpose of this study was to explore nurse managers' experience with ethical issues in six government hospitals in Malaysia including learning about the way they dealt with the issues. Methods: A cross-sectional study was conducted in August-September, 2010 involving 417 (69.2%) of total 603 nurse managers in (...) the six Malaysian government hospitals. Data were collected using three-part self-administered questionnaire. Part I was regarding participants' demographics. Part II was about the frequency and areas of management where ethical issues were experienced, and scoring of the importance of 11 pre-identified ethical issues. Part III asked how they dealt with ethical issues in general; ways to deal with the 11 pre-identified ethical issues, and perceived stress level. Data were analyzed using descriptive statistics, cross-tabulations and Pearson's Chi-square. Results: A total of 397 (95.2%) participants experienced ethical issues and 47.2% experienced them on weekly to daily basis. Experiencing ethical issues were not associated with areas of practice. Top area of management where ethical issues were encountered was "staff management", but "patient care" related ethical issues were rated as most important. Majority would "discuss with other nurses" in dealing generally with the issues. For pre-identified ethical issues regarding "patient care", "discuss with doctors" was preferred. Only 18.1% referred issues to "ethics committees" and 53.0% to the code of ethics. Conclusions: Nurse managers, regardless of their areas of practice, frequently experienced ethical issues. For dealing with these, team-approach needs to be emphasized. Proper understanding of the code of ethics is needed to provide basis for reasoning. (shrink)

Purpose – The purpose of this paper is to present a descriptive literature review and a classification scheme for studies on sustainable development, e-learning and Web 3.0 that contribute toward sustainable e-learning. The aims are to discover and highlight some ideas on developing a sustainable learning in higher education in Malaysia. Design/methodology/approach – The paper examines the elements of e-learning, technology, application, sustainable development and teaching and learning principles that contribute toward a sustainable e-learning through a descriptive literature review approach (...) and a classification scheme. Findings – The findings show that even though sustainable e-learning research is still limited, contributions to sustainable e-learning were recognized and some ideas and perspectives for the development of a sustainable e-learning framework were identified. Furthermore, this paper identified the gaps in the findings; therefore, this paper will try to minimize these gaps through the initial sustainable e-learning framework. Originality/value – The paper is expected to provide further ideas of developing a sustainable e-learning framework, as well as the importance of a sustainable e-learning to provide quality learning through technology, application, sustainable development and teaching and learning principles perspectives. With the development of communication and computer technology, the application of big data technology has become increasingly widespread. Reasonable, effective, and fast retrieval methods for querying information from massive data have become an important content of current research. This article provides an image retrieval method based on the weighted nearest neighbor label prediction for the problem of automatic image annotation and keyword image retrieval. In order to improve the performance of the test method, scientific experimental verification was implemented. The nearest (...) neighbor weights are determined by maximizing the training image annotation, and experiments are carried out from multiple angles based on the Mahalanobis metric learning integration model. The experimental results show that the proposed tag correlation prediction propagation model has obvious improvements in accuracy, recall rate, break-even point, and overall average accuracy performance compared with other widely used algorithm models. Thoughts and thinking on Malay philosophy and literature.

Substantial literature has investigated the relationship between religiosity and ethical decision-making (the what), while lesser consideration has been given to exploring why decisions are made. As part of a larger study, this paper aims to delve beyond the descriptive relationship between religiosity and ethical decision-making of Muslim employees in Malaysia. We analyse the qualitative data received from 160 employees by using thematic analysis. Our results reveal that, while religious values are important for Muslims in Malaysia, there are other factors that (...) are also pertinent when making decisions at work, namely the organization’s interest and the context of the decision. We also found that individuals’ reasoning based on Islamic teachings is embedded in rules and regulations, which suggests lower levels of ethical reasoning. This study extends the current understanding of the processes of ethical reasoning in highly religious contexts by individuals at their workplace. With the development of teachers’ psychological cognition, the moral education curriculum develops as per the changes in times. Currently, a resurgence of interest on studying teachers’ perceptions of the moral education curriculum has observed. This is because moral education curriculum of each country plays a unique role in the overall design of the country’s education curriculum. However, studies on teachers’ perceptions of the moral education curriculum are scarce, and no framework has been developed to guide the teaching and learning of (...) teachers for the moral education curriculum for schools. The moral education curriculum serves as one of the main vehicles for value education, with teachers as direct executors. It can influence the overall development of the school system and long-term development of a country. Thus, in this paper, we reviewed current literature related to teachers’ perceptions of the moral education curriculum and developed future trends considering teachers’ perceptions of the moral education curriculum in improving existing moral education programs in a country. We identified a list of keywords related to moral education curriculum and teacher perceptions and relevant to the scope of this study. These keywords were used to search the articles from the Scopus and WoS studies. Overall, 32 papers meeting the search criteria were retrieved. Further, we conducted thematic studies, and four themes were successfully identified: the model of teacher perceptions of moral and national education, the dimensions of the teacher ethics model, teaching strategies, and the role of teachers. The results of this study suggested a new framework for research trends in teachers’ perception models, particularly toward the moral education curriculum. This study contributed to the knowledge regarding teaching and learning approaches of moral education considering teachers’ perceptions of the moral education curriculum. The findings of study would benefit future studies and would improve the implementation of a country’s moral education program. (shrink)

Teachers involved in English as a foreign language (EFL) teaching play a significant role in the process of moving toward educational equity. Teacher cognition is very influential in shaping teacher practice and thus affects students’ academic performance. However, although the role of EFL teachers as equity agents has been recognized, few studies have explored EFL teachers in-depth in terms of their cognition and practice. Moreover, no review studies have given sufficient attention to the task of elucidating the interrelations between EFL (...) teachers’ cognition and practices in the context of educational equity. Therefore, to provide a novel perspective and generate fresh insights into this research field, the current study attempts to explain the connotations of these constructs, highlights the interplay between EFL teachers’ equity-oriented cognition and practice, and identifies both experiential and contextual factors that might have an effect throughout the teaching process. Finally, practical implications and directions for teachers, researchers, policy-makers, and social justice leaders who are interested in actualizing education as a means of attaining equity are also discussed. High turnover intention is a problem in the workforce today. The purpose of this study is to determine the relationship between experienced workplace incivility and psychological well-being on turnover intention. The subjects of this study were 46 millennial employees who had worked for at least three months. Data were collected with turnover intention scale, experienced workplace incivility scale, and psychological well-being scale. Partial Least Square PLS-SEM analysis was used to analyze the data. Findings indicate that experienced workplace incivility is positively (...) related to turnover intention, while psychological well-being is negatively related to employee turnover intention. The results show that workplace incivility affects employee turnover intention higher than psychological well-being for millennial employees. Connections and communality are characteristics of millennial employees; therefore, they consider that the environment is essential. It is essential for employers to develop a work condition that minimalizes experienced workplace incivility and improves the psychological well-being of their employees to reduce turnover intention among millennial employees. E-commerce has led to a significant increase in internet purchases. The marketing sector is very competitive these days, and marketers have a difficult task: understanding the behavior of their customers. Strategic marketing planning relies heavily on consumer behavior since the consumer acts as the user, buyer, and payer in that process. Consumers’ behavior changes in response to shifts in the factors that influence it. The purpose of this research is to show how Internet usage influence on consumer impulsive buying behavior (...) of agriculture products through moderating role personality traits and emotional intelligence in China organic market. The data gathered in three months from January to March 2022, due to COVID-19 pandemic data was gathered through an online survey questionnaire sent by Chinese social media platforms including WeChat and an email address. The PLS-SEM technique and the SmartPLS software version 3.2.8 were used for data analyses. The result revealed that internet usage positively and significantly influences consumer impulsive buying behavior. Also, both moderator personality trait and emotional intelligence positively and significantly moderate the relationship between internet usage and consumer impulsive buying behavior. AimThe current study attempted to assess the effect of positive emotion on post-graduate students’ psychological capital as well as on their academic engagement behavior. Also, the direct relationship between PsyCap and academic engagement behavior was assessed alongside the presence of Stress as a moderating variable between PsyCap and academic engagement behavior amongst post-graduate students in Malaysia.Materials and MethodsA self-administered questionnaire was used for data collection from 373 post-graduate Ph.D. students registered in various universities throughout Malaysia with a non-probabilistic sampling technique. (...) Research respondents belonged to management, humanities, engineering, computer science, and health sciences domains, and they responded through a questionnaire copy. Statistically, structural equation modeling was applied to evaluate confirmatory factor analysis, reliability analysis, validity analysis, measurement model, structural model, and path analysis. Furthermore, the bootstrapping approach was utilized to test the final model.ResultsFor the hypothesized model, our results confirmed that positive emotions had a positive and significant effect on students’ psychological capita as well as on their academic engagement behavior. Further, PsyCap also had a positive and significant effect on academic engagement behavior. Our results also reported that stress as a moderating variable has a negative and deteriorating effect on the relationship between PsyCap and the academic engagement of students.ConclusionThe study’s findings support the theoretical assumption that positive emotions help individuals generate cognitive resources, which in turn help them manage their engagement behavioral requirements. However, the stress caused by their study needs may deplete their psychological resources, consequently influencing their academic engagement behavior. Interventions like personal coaching/counseling, appropriate follow-up, and flexible goal settings with other measures may help post-graduate students in achieving their daunting tasks. (shrink)

Specifically, it will investigate whether dialogue aids students in acquiring vocabulary. Vocabulary is a crucial component of language, alongside sounds and structures. Teaching vocabulary is an essential part of foreign language programs, including Arabic. However, despite its significance, the learning and teaching of Arabic vocabulary to non-native learners face several challenges, contributing to their weaknesses in this area. Credible and well-functioning governance is crucial for the value creation of firms. Recently, private sectors have undergone substantial changes by focusing on good governance as a tool to enhance value, reputation, and image. The primary features of firms with good governance include greater emphasis on accountability practices, proper implementation of a corporate integrity system, and sound internal controls in place to avoid risk and to ensure policy and procedures that are complied. Government linked companies (GLCs) as the backbone of the (...) Malaysian Government have been harshly criticised for not being able to create value(s) despite receiving high priority in the process of getting government projects. Therefore, this study aims to examine the role of good governance systems, which are reflected through accountability systems, corporate integrity systems, and internal control systems towards value creation of Malaysian GLCs. This study collected primary data based on a set of questionnaire survey among 100 GLCs in Malaysia. The study explores the sociolinguistic aspects of language, particularly its impact on the interactions between Javanese and Malay tribes, which significantly influence each other. As a result of people moving from one place to another, there was interaction between the Javanese and Malay Deli communities, which was known as Javanese Deli or "Ja-del." This resulted in language contact and the emergence of new terminology as a result of the community's social interactions. In North Sumatra, there are Javanese and Malay communities. (...) linguistic contact in Javanese and Malay societies gave rise to a variety of linguistic phenomena such as "language codes" and "symptoms of code switching and code mixing." Acculturation of Javanese and Deli Malay culture resulted in a blending of language comprehension and belief values in both parties' civilizations. This research approach employs a qualitative paradigm with 112 informants; however, for the sake of efficiency and accuracy, 60 sources were chosen based on expertise and character. This study explores The use of Javanese by people in Deli Serdang Regency, Serdang Bedagai Regency, Langkat Regency and Batubara Regency is gradually changing. Based on the recognition of the Javanese people, the language used in the Deli Serdang Regency, Serdang Bedagai Regency, Langkat Regency and Batubara Regency was originally pure Ngoko Javanese. The culture of the Javanese Deli community in North Sumatra Province contains a mixture of cultures that lead to globalization. When communicating, the speaker conveys the speaker's speech using Indonesian (BI) and a foreign language (BA) with no intervention from each speaker. (shrink)

Intersex being a birth impairment in human babies is a fact of humanprecreation. The general relationship between a bank and customer is contractualin nature. For conventional banks, the banker-customer relationship is basedon the debtor-creditor relationship with the bank earning a profit from a spreadmade between interest charged on the borrower of funds and interest paid tothe depositors. In Islamic banking, due to the different contractual transactionsof Islamic banking operation, it is based on a multi-contractual relationships.However, bank consumers perceive that banks enhance their profits by treatingconsumers unfairly and failing to take responsibility when things (...) go wrong.This study examines the duty of care of conventional and Islamic banks towardsbank consumers. It also focuses on the Islamic banks’ duty of care from theperspective of maqāṣid al-Sharī‛ah, to those who use their services. Adoptingthe doctrinal analysis method, this study analyses and compares the duty ofcare of both conventional and Islamic banks. Findings of this study includethat misconduct by banking industries remains rife and that unfair treatment ofcustomers are frequent. As for Islamic banks, the maqāṣid al-Sharī‛ah basedduty of care is found missing in their Islamic banking operation. This studysuggests that the duty of care for both banks should be reformed to improvebank consumers’ experience. There is a growing global interest in social responsibility and sustainability across all sectors. Other than economic performance, stakeholders are now also concerned about the social and environmental impacts of corporations. Additionally, stakeholders are obtaining a higher salience level and expect organisations to operate sustainably. The banking sector has not been an exception, as banks can have significant impact on their customers, employees, and society in various ways. Given the intertwined links of Islam and ethical principles, it is expected that (...) Islamic banks will show a high level of commitment towards social responsibility (SR) and ethical practices. The current study investigates this issue by examining the annual reports of three fully-fledged Islamic commercial banks in Indonesia over the period of 2007 to 2011. It was found that only two of the investigated banks had continuous improvement in their SR disclosure. Additionally, it was revealed that the highest disclosures have been for ‘corporate vision’ and ‘board of directors and top management’, while the lowest disclosures were evident for ‘environment’ and ‘product, services and fair dealing with supply chain’. The possibility of accomplishing sustainable objectives is largely connected to the management and flourishing of an organizational system which keeps human capital engaged and committed. Our study investigated the association of inspirational leadership and innovative communication with employee engagement and commitment under the lens of leader member exchange theory. Specifically, we emphasized the mediating role of mutual trust in connection to social sustainability facets. A survey of data from employees in the manufacturing sector of Yunnan, China was utilized to test (...) the hypothesized model. The study findings reported a significant association and came to the conclusion that a leader’s inspirational behavior coupled with innovative communication is a significant predictor of engagement and commitment in socially sustainable organizations. Moreover, mutual trust significantly mediated the relationship of innovative communication and inspirational leadership with employee engagement and commitment reaching the social perspective of sustainability. In 2017, the global Blockchain technology market was predictedto reach 339.5 million U.S. dollars in size and is forecasted to grow to 2.3billion U.S. dollars by 2021. The smart contract has an increasing role ingoverning the legal relationship between the interested parties. This researchexplores the current position of smart contracts in Malaysia and the viabilityof the Malaysian framework in handling the latest development. This researchadopts the qualitative and doctrinal legal approaches in analysing the currentlegal practice, the relevant statutes and the (...) viability of the Malaysian legalframework. These approaches are necessary to be carried out in ensuring theworkability of smart contracts in Blockchain. Additionally, the practices ofsmart contracts from international experiences are collected as case studies inthis research. As a part of the findings, the researchers found that smart contractsare more or less similar to traditional contracts. Therefore, the requirements asstipulated under the Contract Act 1950 that are applicable in Malaysia mustbe followed accordingly. Nübüvvet mührü; (hâtemü’n-nübüvve) siyer, şemâil, hasâis, delâil türü İslâm Tarihi kaynaklarında yer almış, kimilerince Peygamberimizin nübüvvetinin tasdikinde delil sayılmıştır. Nübüvvet mührü bir alamet olarak Ehl-i kitap mensuplarının kaynaklarında da yer almıştır. Ehl-i kitaba göre, son peygamberin nübüvvet alameti omzu üzerinde, kürek kemikleri arasındadır. Ancak bu alametin mahiyetine dair herhangi başka bir rivayet mevcut değildir. Ehl-i kitap üzerinden aktarılan rivayetlerin nübüvvet mührüne mucizevî bir anlam yüklediğini görmek mümkündür. Rivayetler muvacehesinde Ehl-i kitap mensuplarından bazıları son Peygamberde bu alameti araştırmış ve bu vesile (...) ile İslâm’la tanışmıştır. Nübüvvet mührüne dair rivayetler hadis kaynaklarımızda da yer almıştır. Bu rivayetlerin bir kısmı peygamberlik öncesi döneme, bir kısmı ise nübüvvet sonrası döneme aittir. Rivayetlerin nübüvvet sonrasına dair olanlarında, Peygamberimizin çevresinde bulunan ashabınca nübüvvet mührünün bizzat görüldüğü yönünde ifadelere de rastlanmaktadır. İslâm tarihi kaynaklarından İbn Saʿd, İbn İshak ve Taberî gibi müellifler nübüvvet mührü rivayetlerine yer vermişlerdir. Nübüvvet mührüne dair rivayetleri kaynaklarımızda; Peygamberimizin doğum hadisesi bölümünde, şakk-ı sadr hadisesi bağlamında, Bedü’l-vahy bâbında, İsrâ ve mi‘râc olaylarında Cebrâil ile ilişkilendirilerek ve Peygamberimizin vefatı başlığı altında Esmâ binti Umeys hadisi vasıtası ile bulmamız mümkün olmuştur. Nübüvvet mührünün özelliklerine dair rivayetlerde dikkat çeken husus Peygamberimizin sırtında iki kürek kemiği arasında irice bir et beninin olduğu vurgusudur. Rivayetlerdeki müşterek nokta burasıdır. Nübüvvet mührünün mahiyeti, ne zaman vurulduğu, neye benzediği konuları da kaynaklarımızda farklı rivayetler doğrultusunda yorumlanmış ve değerlendirilmiştir. Bu bağlamda nübüvvet mührü, İslâm tarihi meseleleri içinde varlığı ve gerçekliği bakımından tartışmalı bir mesele olarak incelenmeyi hak etmektedir. Öte yandan Peygamberimizin ağzından, sırtındaki bu ben hakkında olağanüstülüğüne dair açık ifadeler bugüne ulaşmamıştır. Bu konuya dair sahih rivayetler ise sadece nübüvvet mührünün çeşitli tasvirlerini bize aktarmaktadır. Bu tasvirler, görenlerin algısına dayandığı için farklılık arz etse de aşağı yukarı tevhid edilebilecek bir tarif bugün için elimizde mevcuttur. Bu mührü normal bir ben gibi görenlerin yanında mucizevî özellikler atfedenler de vardır. İslâm tarihi içerisinde farklı kabullere ve görüşlere açık bir şekilde değerlendirilmiş olan nübüvvet mührünü, Peygamberimiz hakkında diğer insanlardan farklı mümeyyiz/ayırt edici bir vasıf olarak ele almak; nübüvvet alameti şeklinde ancak fiziksel olarak tabiî bir tarzda kabul etmek gerekir. Kitap ehlinin bu konudaki bekleyişi, gerek hadis gerekse siyer kaynaklarındaki nübüvvet mührü ifadeleri bizi bu noktaya sevk etmiştir. (shrink)

The subject of general utterances (al-lafdh al-āmm) being certain or presumptive in their usage as an indication to all their members is controversial amongst the methodists. Ḥanafī methodists suggest that the indication of general utterances to all of their members as certain and unless they are specified with a certain evidence, they can’t be specified with a presumptive evidence. Like the ḥanafī methodists, the ẓāhirī methodists also suggest that the general utterance is certain indicant for all of its members and (...) can be specified only with another evidence in the same rank. The main difference between the two groups focuses on whether al-khabar al-wāhid (single prophetic narration) is a certain or a presumptive evidence in terms of certitude. According to ḥanafīs, al-khabar al-wāhid is a presumptive evidence and unless the general utterances in Qur’ān are specified initially with another certain evidence, they can’t be specified with al-khabar al-wāhid. However, al-khabar al-wāhid is a certain evidence according to ẓāhirīs and it can specify general utterances in Qur’ān. In this study, the comparison of the views of the methodists of two schools regarding the indication of general utterances in Quran and their specification (takhsīs) with al-akhbar al-wāhid is made and their influence on Islamic Law regulations is studied afterwards. In this study, the two sect’s approaches are compared over the provision of reading al-Fatehah during prayer, the number of milk sucking to establish the kinship, the rights of women divorced with bain talaq and the execution of the death penalty in the Harem region.Summary: The purpose of this study is to try to demonstrate that an assertion in the Ph.D. thesis, The History and Doctrine of Ẓāhirī Madhhab, completed by Amr Osman in 2010 is incorrect. It can be summarized that in his study, Amr Osman claims that the affiliation of the schools to ahl-al-hadith and ahl-al-ra’y in conventional classification is wrong. According to him, contrary to what is known, the School of Ẓāhiriyya is closer to School of Ḥanafiyya rather than schools coming out of ahl-al-hadith. In this study, one of the arguments that he relied on to support his claim is studied in order to prove that his claim was inaccurate. Osman claims that ẓāhirīs are closer to ḥanifīs, based on the view that in both schools the general utterances embrace all of their members in their usage and they are a certain indicant to all of their members. At this stage, although the views of both schools are common, the ḥanifīs don’t accept the idea that the general statements of Qur’ān can be established with al-khabar-al-wāhid, those which they acknowledge as presumptive as of certitude. However, according to the ẓāhirīs, the certitude of al-khabar al-wāhid is as precise as the narrated report, so it can specify the general statements of Qur’ān which are in equal power. The related dispute between the schools has been reflected on many Islamic law regulations. Some of them are:1. Ḥanafīs state that the correct Quranic prayer may be performed by reading any or a few verses of the Qur’ān in prayer, which is a practice based on the verse “Read what you can read from the Qur’ān now”. On the other hand, the ẓāhirīs have established the related order based on the report “There is no prayer without reading Umm Al-Quran (Surah al-Fatehah)” and it is obligatory (fardh) to read Surah al-Fatehah in prayers.2. Because that the terms milk-mother and milk sister are in general form in the verse “It is forbidden to you to marry these people...Your milk-mothers who nursed you, your milk-sisters who nursed you” the ḥanafīs clarify that it is sufficient for a child to breastfeed only one time in order to form a milk-kinship. They do not act in accordance with the solitary report (al-khabar-al-wāhids) which indicate that the milk kinship specifying the verse shall only be formed with at least three or five breastfeeding. However, one of the ẓāhirīs, Dāwūd al-Ẓāhirī, has specified the verse with the report indicating that the kinship shall not be formed with less than three breastfeeding by the child, and Ibn Ḥazm has specified it with Salim hadith which indicates that the kinship shall be formed with five breastfeeding.3. According to ḥanafīs, there is an alimony and inhabiting right of the widow woman to be procured by the husband within the period of delay who divorced her either with irreversible divorce (talāq al-bāin) or reversible divorce (talāq al-ric‘ī) according to the generalization of the verse “Give shelter to them (the women you have divorced) in some part of your household within your capacity.” They did not act with the report of Fātima binti Qays, who specified the generalization of the verse. On the other hand, the ẓāhirīs recognize the abovementioned rights only for the women who got divorced with irreversible divorce or the ones who are pregnant, specifying the verse with the report indicating that His Holiness the Prophet does not grant alimony and inhabiting to the woman who was divorced with reversible divorce.4. According to ḥanafīs, the criminal who committed a crime that would require a death penalty and took refuge in the Harem region could not be executed while in Ḥarem, according to the common statement of the verse, “Whoever enters there, will be safe.” Dāwūd al-Ẓāhirī, one of the ẓāhirīs has specified the verse with the report indicating that His Holiness the Prophet has authorized the execution of the sentence to Ibn Khattal in Ḥarem on the day of the conquering of Mecca and he states that the death sentence can be executed wherever the criminal is caught, even if it is inside the Harem. Ibn Ḥazm shares the same view with ḥanafīs regarding the provision of this issue. However, the reason for his opinion stems from the fact that the report about Ibn Khattal was an event specific to that day. As it is seen, even though the ḥanefīs and ẓāhirīs share the same opinion about the general utterances being a certain indicant to all their members, they have disagreements upon the argument about the general utterances of Quran being specified by al-khabar al-wāhid and many Islamic Law regulations have been issued by these schools based on such disagreements. According to us, in the final analysis, Amr Osman’s claim must be met with caution. (shrink)
